Consent Agenda


1. Request approval of Amended Task Authorization/Guaranteed Maximum Price (GMP) for CMAR Services - Palm Island Park Kayak and Canoe Launch (Faden Builders). A modern, ADA-compliant kayak and canoe launch is not currently available at this or any other waterfront City park. The proposed launch will be an access point to the Lake County Blue Way System, a route used by thousands of Florida residents and visitors each year. This particular "trail" guides paddlers through scenic waterways with physical and geo-positioned markers, and is suitable for casual and novice users who are eager to explore the area. The launch can also be used for active recreational programs such as specialty youth summer camps. This project will cost $300,000 of which $240,000 comes from a Recreational Trails Program (RTP) grant from the Florida Department of Environmental Protection.
2. Request approval of the Edward Byrne Memorial Justice Assistance Grant (JAG). The Mount Dora Police Department has applied for a $4,719 grant that does not require any matching City funds. The grant has been awarded and Council approval of acceptance is requested. MDPD will use grant funds to purchase three (3) new short-barreled rifles (SBRs). The SBRs would be easier for officers to transport and less visible to the children and faculty. The expectation is that the SBRs will make our schools feel less militarized, while keeping the children safe, and keeping the environment more conducive to learning.
3. Request approval of the Piggyback Agreement with Asphalt Paving Systems, Inc., related to Pavement Maintenance and Rehabilitation Continuing Services and authorization to utilize Asphalt Paving Systems, Inc., for annual road repaving in an amount not to exceed $295,432.15. The City of Mount Dora streets require continual maintenance to provide safe and reliable surfaces for driving and/or pedestrian traffic. A well-maintained pavement prevents water from encroaching into the roadway base material, which significantly accelerates deterioration of the paved surface. The proposed resurfacing method consists of sealing cracks in the roadway and performing a micro surface overlay on the selected roadways. Public Works has budgeted for 5 new speed tables to be installed with this contract. The following streets where the speed bumps will be constructed are: Three (3) on Overlook Dr, One (1) on Heim Road between Oakland and Old 441, and One (1) on Tremain between the boat ramp and Charles.
4. Request Approval of Meeting Minutes -November 16, 2021, Regular City Council Session Minutes

Action Items

1. Request adoption of Resolution 2022-04, FY 2021-2022 Budget Adjustment. Details of the $5.5M budget adjustments are available in the City Council agenda packet which can be downloaded on the City’s website. If you have specific questions please reach out to me or your District Councilmember.
2. Request adoption of Resolution 2022-03, Master Fee Schedule Update. Details of the master fee schedule changes are available in the City Council agenda packet which can be downloaded on the City’s website. RAFTELIS as requested by, Council on August 4, 2021, has completed a water, wastewater, and reclaimed water revenue sufficiency study, a stormwater revenue sufficiency study, a sanitation review sufficiency study and a review of the City's Fiscal Year 2022 general fund cost allocation methodology. RAFTELIS is recommending that the following fees be implemented: 1. Water and wastewater rates increase by 3.6% 2. Stormwater rates increase by $1.00 per month 3. Sanitation rates increase by 3.5%.
3. Request approval of the Third Amendment to Solid Waste Agreement between the City and Waste Management Inc. of Florida. The proposed rate that Waste Management charges for both residential and commercial solid waste services to the city is projected to increase by 3.5% pursuant to the franchise agreement.

Public Hearings - Resolutions/Ordinances

1. Request approval of First Reading Transmittal Hearing Ordinance No. 2021-24, Large-Scale Future Land Use Map Amendment for Mount Dora Groves. This is a request for City Council to approve the first reading of Ordinance No. 2021-24 for Transmittal to the State Department of Economic Opportunity and hold a hearing for the second reading and adoption. From County: Regional Office, Commercial, Urban Low, and Urban Medium ~ To City: Commercial, High Density, Medium Density, and Low Density. From: County 362 residential units ~ To City: 1,354 residential units. From: County 10.5+ million square feet ~ To: City 285,100 square feet.
2. Request adoption of Resolution No. 2022-01, Preliminary PUD Master Plan for Mount Dora Groves. This is a request for City Council to approve Resolution No. 2022-01, for the Mount Dora Groves Preliminary PUD Master Plan with Conditions. The Planning and Development Department staff with review with the City's planning consultant has evaluated the Prelimary PUD Master Plan and has provided conditions to be incorporated into the Final PUD Master Plan. The Conditions are as follows: Preliminary PUD Master Plan Conditions ~ The following items shall be addressed and incorporated into the Final PUD: 1) Detailed and enhanced residential design and site standards are required for all housing types (including but not limited to apartments, townhomes, duplex, single-family and/or any other residential housing). 2) Townhome product size and design. Rear loaded townhome product required. 3) Traffic Impact Study required at Final PUD submittal. 4) Provide option for residential Pods D, E, and F, located on the south side of 441, adjacent to Pod C, in order to allow the potential for additional non-residential uses, calculated at the ratio maximum of 25% of the residential lands for Pods D, E, and F, (54 acres x 25% = 13.50 acres). Meaning: complementary commercial/office may be included not to exceed an additional 13.50 acres if harmoniously designed to incorporate into the total PUD. Alternatively, more commercial/office than shown on the proposed master plan could be added. 5) Convert any build-to-rent section of the Pods to single-family houses or mixture of single-family and duplexes with fee simple ownership.
3. Request approval of First Reading of Ordinance No. 2022-01, PUD Master Plan 2nd Amendment for Donnelly Woods. The master planned community is located east of Donnelly and on the north side of Limit Avenue. The project has a total site area of approximately 16.69 acres for a two-phase development: Phase one includes six office buildings fronting Limit Avenue and phase two will be developed as a multiple-family community. The proposed changes to the PUD Master Plan include the following items: 1) Multiple-Family from 112 units to 164 units. Senior Housing Type Residents; 2) Multiple-Family Building Height from 3-Stories 45 feet to 4-Stores 55 feet; 3) Multiple-Family parking ratio from 2 spaces per unit to 1.4 spaces per unit; 4) Multiple-Family Architectural Elevations; 5) Total Open Spaces from 0.55% to 0.62% (required is 0.25%); 6) New Donnelly Street ingress/egress; 7) Phase 1 Office Site Plan expiration date within one year from adoption date of the PUD Amendment Ordinance; and 8) Traffic Impact Study required with the submittal of the Phase 2 site plan.
4. Request approval of First Reading of Ordinance No. 2022-02, PUD Master Plan Amendment for Villages of Loch Leven. The development project is located on the east side of SR 44 at Meadenhall Boulevard. This is an existing Planned Unit Development originally adopted in 2000. The single-family section of the master plan (Lancaster at Loch Leven) was platted in 2010. A total of 113 homesites were built. The remaining section of the development remains vacant. Originally planned for optional multi-family, office, and/or general commercial. The proposed PUD amendment modifies the remaining portion of the development facing SR 44 with multifamily residential. The proposal is to build the remaining multifamily area of the PUD with a maximum of 125 units. A small area will remain for future commercial/office or multi-family. The developer has committed to dedicating 2.01 acres to the City as a public park. In general, the proposed master plan amendment includes the following changes to the Villages of Loch Leven:  Commercial/office parcel from 9 acres to 1.30 acres.  Two (2) acres for a City park.  SR 44 buffer width from 65 feet to 40 feet.  Townhomes: 125 units
7. Final reading and adoption of Ordinance No. 2022-03, Building Height Moratorium. The City Council, at their regularly scheduled meeting held on January 4, 2022, recommended approval of the First Reading of Ordinance No. 2022-03 and hold hearing for the Second Reading and Final adoption.
8. Request adoption of Resolution 2022-08, Amending Building Height Advisory Committee. On September 21, 2021, the City of Mount Dora adopted Resolution 2021-115, creating the Building Height Advisory Committee. The initial committee meeting was held on November 18, 2021. The City Council, through Ordinance No. 2022-03 has established a temporary moratorium for one year related to building height code changes, variances or other actions. Given the amount of research needed by the committee and for consistency with the temporary moratorium ordinance, the formal Building Height Committee resolution needs to be amended to match the moratorium provisions.
