CONSENT AGENDA

1. Request adoption of Resolution No. 2022-41, Maximum Millage Rate for Fiscal Year 2022-2023 Budget. In conjunction with the Notice of Proposed Property Taxes (TRIM Notice) pursuant to Section 200.069, F.S., the City Council must authorize advertisement of the maximum millage rate for the upcoming budget year and to establish budget hearing dates in September. The proposed maximum millage rate of 6.1000 mills. If you have in-depth questions about the millage rate please feel free to ask. It can be rather confusing.


2. Request approval of Reimbursement Agreement between Duke Energy Florida, LLC; Florida Municipal Power Pool (FMPP); City of Mount Dora and Orlando Utilities Commission (OUC). Council approved this agreement on July 21, 2020 with Resolution 2020-111.  However, once the good faith estimate was received, it was cost prohibitive and it was decided not to move forward. Since then, Duke Energy has made some major communication improvements to their system which may bring down the cost dramatically. Accordingly, Mount Dora and OUC are requesting Duke Energy to provide another estimate to "pseudo-tie"  Mount Dora's load to FMPP, which is controlled by OUC. In order to obtain this estimate, Duke Energy requires a new agreement to be signed by all parties. This new Reimbursement Agreement will commence September 1, 2022, and will supersede the agreement approved under Resolution 2020-111 on July 21, 2020.


3. Request adoption of Resolution No. 2022-45, Fire/EMS Impact Fee Credit for Fire Station 34/EOC. The City of Mount Dora is in the final design stage of constructing a replacement Fire Station 34 and combined Emergency Operations Center (EOC) located on the north side of Limit Avenue west of Grandview Avenue.  As the City's CMAR contractor begins its pricing exercise, the City requests full credit of the Fire/EMS Impact Fee for Fire Station 34/EOC. Because Fire Station 34 and the Emergency Operations Center are a public safety facility, the impact on City fire facilities is $0 or 100% creditable.  Accordingly, Wharton-Smith is requesting a full credit of the Fire/EMS Impact fee for Fire Station #34.

ACTION ITEMS

1. Request Adoption of Resolution No. 2022-46, Accepting the FY 2020-2021 Comprehensive Annual Financial Report (CAFR)/Audit prepared by Purvis Gray & Company, LLP and adopting Time Parameters and Procedures. The Comprehensive Annual Financial Report (CAFR) for the year ending September 30, 2021, has been completed. Pursuant to City of Mount Dora Charter, Article II, Legislature, Section 9, Duties, the City Council shall adopt, by resolution, the time procedures for the correction of all deficiencies noted in the CAFR.


2. Request approval of the Agreement between the City of Mount Dora and A.C. Schultes of Florida, Inc., for Construction Services - Well 3 at Water Treatment Plant (WTP) 2. The City has two water plants. WTP #1 has sufficient well and pump capacity to meet the daily potable water needs of the entire City.  WTP #2 does not have the well or pump capacity to serve the entire City should WTP #1 experience a major disruption of service. This project will be the first step towards providing plant redundancy for the City's potable water system. This project is only for the installation of the well bore and well production-development. Engineering for equipment installation to connect the new well to WTP #2 is scheduled for fiscal year 2023-2024 (Capital Improvement Project Budget Item Estimate: $90,000). Construction and installation of the equipment is scheduled for fiscal year 2024-2025 (CIP Budget Item Estimate: $800,000).


3. Request approval of Amendment 3 between the City of Mount Dora and Allied Universal Corporation for Sodium Hypochlorite. Martin County has an Agreement with Allied Universal Corporation to provide chemicals (sodium hydroxide and sodium hypochlorite) for water and wastewater treatment.  The City piggybacks on this contract to supply the City's WWTFs (WasteWater Treatment Facility) and WTPs (WasteWater Treatment Plant).  The original agreement between Allied Chemical and Martin County was renewed on July 3, 2022.  The CoMD needs to renew its piggyback on this agreement to continue to receive deliveries from Allied at the agreement pricing. The original agreement included a price increase for both sodium hypochlorite (40%) and sodium hydroxide (28%).


PUBLIC HEARINGS - RESOLUTIONS/ORDINANCES

1. Request adoption of Final Reading of Ordinance No. 2022-09, Change in Zoning – Daniel C. and Judith Ann McWhorter. This is the final reading of this Ordinance. The applicant is requesting a change of the zoning district WP-1 (Workplace) to City MU-1 (Mixed Use Traditional) for approximately 8.77 acres located on the southeast corner of Highland Street and Camp Avenue. This request is for the MU-1 zoning to be consistent with the underlying Future Land Use designation. The applicant currently does not have a development plan for the property and is only seeking to rezone the property so that the zoning district matches the land use category. Future development of the property will require the submittal of a development application (preliminary plat, site plan, etc).


2. Request approval of First Reading of Ordinance No. 2022-15, Amending Ordinance 2021-01/Chapter 38, Article V, Public Parks and Recreation or as otherwise codified in the Code of Ordinances. A letter was sent to the Mayor dated June 12, 2022, from Florida Carry, Inc., (a non-profit organization which promotes gun rights in Florida) placing the City on notice that certain language within its recently adopted public parks and recreation ordinance/code, related to the discharge of fire arms, was pre-empted by State law.  The City Attorney brought the matter to the attention of Council at the next regularly scheduled meeting and instruction was given for an ordinance to be drafted repealing the portion of the City's Code containing the language to which Florida Carry had objected. In addition, recent legislation was passed allowing local governments to regulate smoking, other than non-filtered cigars, within parks and on beaches.  In reviewing the City's public parks and recreation code related to the fire arm language, it was determined that more stringent smoking regulations, consistent with prior City intentions, could now be imposed in the City's parks.  The additional revisions reflect the smoking regulations which are now permitted under Florida law.


3. Request approval of First Reading of Ordinance No. 2022-16, Amending Chapter 8, Animals, of the Code of Ordinances. On May 17, 2022, the City of Mount Dora approved an Interlocal Agreement with Lake County and the Sheriff of Lake County for the provision of animal control services within the jurisdictional boundaries of the City of Mount Dora.  The Agreement provides that Lake County/Sheriff of Lake County will enforce the Lake County Code related to animal control in the City of Mount Dora.  As such, it is imperative that the City adopt the Lake County Code for enforcement within the jurisdictional boundaries of the City of Mount Dora.  This Ordinance specifically adopts the Lake County Code in Mount Dora and repeals the portions of the City's Code which are inconsistent with the Lake County Code or which will still remain in force in the City through City forces separate and apart from the animal control efforts of Lake County/Sheriff of Lake County.
