CONSENT AGENDA

1. Request Approval of Task Authorization with RCM Utilities, LLC for the Rehabilitation of Lift Stations 4 and 5. Lift Station #4, 550 Johns Avenue, is in need of rehabilitation and repair to extend the service life of the facility and address any safety issues. RCM will install a new wet well liner, new hatch cover, new check and plug valve, and relocate force main piping. Due to the lack of space at Lift Station #4, there is no room for a backup generator on site. Lift Station #5, 508 Chautauqua Drive, has a generator. The work scheduled to be performed between both of the lift stations will allow the City to harden the system in storm season, lower the risk of an overflow during a power outage and preclude any safety issues. The estimate is for $122,484.00 which is under the budgeted amount.

2. Request Approval of Task Authorization with Faden Builders, Inc. for the Wastewater Treatment Plant No. 1 Fence Perimeter Clearing. The Florida Department of Environmental Protection (FDEP) requires that the perimeter fence at all wastewater treatment plants be maintained vegetation-free as a matter of site security. This project satisfies FDEP's February 2024 Permit condition for renewal of the City's permit. The fence line has been severely overgrown with trees and other vegetation in several areas along the western and southern fence lines at Wastewater Treatment  Plant 1 (WWTP#1). The FDEP identified this as a security concern. This project clears the fence line within the City of Mount Dora's property for WWTP#1. The project cost is $102,148.90.

ACTION ITEMS

1. Special Magistrate Recommendation for MK and AD Land Investments, LLC and AMCO Development, Inc. vs. City of Mount Dora. Staff recommends that the City Council accepts the recommendation of the Special Magistrate's determinations and conclusions.  

2. Release Settlement Agreement for MK and AD Land Investments, LLC and AMCO Development, Inc. Staff recommends approval of the Release Settlement Agreement. The City Council, by virtue of its approval of this Settlement Agreement and consistent with Section 70.51(21)(a), Florida Statutes, accepts the Special Magistrate Recommendation as submitted and agrees to proceed to implement the Special Magistrate Recommendation by consideration of the modified MDMU PUD described therein at a public meeting.

PUBLIC HEARINGS - RESOLUTIONS - ORDINANCES

1. Request Final Reading and Adoption of Ordinance No. 2023-04 Final PUD Mount Dora Mixed Use for MK and AD Land Investments, LLC. The applicant's proposal is to create a Planned Unit Development (PUD) for the Mount Dora Mixed Use project located south side SR 46 within the Wolf Branch Innovation Districts. These lands were recently annexed under Ordinance No. 2022-11 on August 16, 2022.

Mount Dora Mixed Use Final PUD (WBI-E Zoning District) Master Plan:  

o Buildings heights range between 50 feet and 150 feet, with the only exceptions being Buildings B & C (175 feet) and Building D (165 feet).

o Minimum building heights of 50 feet and 85 feet have been established for the two (2) out-parcels fronting State Road 46 (i.e., Tracts 1 and 2).

o Prohibit mini-storage, residential (except fee simple residential in a mixed-use building), large box retail, and commercial uses from being developed on Tracts 1 and 2.

o The park area (e.g., kids' splash pad/water play zone, etc.), will be accessible to members of the public and not limited solely to residents of the MDMU PUD.

o Phase 1 of the MDMU PUD shall require a mixture of residential and nonresidential uses (including office and other employment uses), and shall include a minimum of 25% office and/or other employment uses

2. Request Final Reading and Adoption of Ordinance No. 2024-11, Wastewater (Sewer) Connection/Impact Fees Amendment. Following a series of City Council presentations and workshops dedicated to the extraordinary circumstances necessitating the need to exceed phase-in limitations held on April 2, 2024, May 7, 2024, and again on May 21, 2024, the attached ordinance is a code amendment for the City's  sewer impact connection fee changing from current $4,215 per unit to proposed $7,975.00 per unit.  The details, justifications, data analysis, and summary are provided in these previous workshop public hearings. Once adopted, there is a 90-day grace period for the effective date.

3. Request adoption of Resolution No. 2024-27, Master Fee Schedule Update for Sewer Impact (Connection) Fees. The City uses a "Master Fee" Schedule to establish fees for a variety of services. The current Master Fee Schedule was last adopted by Resolution No. 2023-58 on December 19, 2023. As such, the Master Fee Schedule now requires updating to ensure all fees are accurately capturing the cost to provide any specific service provided. Once adopted there is a 90 day grace period for the effective date.

4. Request approval Final Reading and Adoption of Ordinance No. 2024-12, Amendment to Chapter 42 of the Mount Dora Code of Ordinances to reinstate Golf Carts on Certain City Streets. This is a request for City Council to approve the final reading of Ordinance No. 2024-12.
