APPROVAL OF AGENDA


CONSENT AGENDA

1.Request Approval of the Piggyback Agreement Between the City of Mount Dora and Universal Engineering Sciences for On-call Building Services. The Building Division has determined that it is necessary to have an on-call provider to handle building inspections, plans review and building official duties on an as-needed basis to provide building services to the public in a timely manner. These are on-call services and only billed when services are provided.


2.Request Approval of Grant Agreement Between the City of Mount Dora and FHWA for the Safe Streets and Roads for All Action Plan. The SS4A grant program is a federal initiative designed to support local efforts that improve local transportation infrastructure and systems to save lives. The grants for transportation improvements are generally 80% federal to 20% local funding. Projects must be part of a federally approved action plan in order to receive the SS4A grants. This agreement is to help fund the City's action plan study that will identify transportation safety improvement projects for future grant funding by FHWA.


3.Request Approval of Vendor Agreement with Lake Community Action Agency Low Income Home Energy Assistance Program for the Vendor Payment (LIHEAP) Program. The City of Mount Dora, in partnership with the Lake Community Action Agency, has been participating in the Low-Income Home Energy Assistance Program (LIHEAP) for approximately 28 years. LIHEAP is a federally funded program that helps income-qualified families with home heating and cooling costs. The Florida Department of Commerce (FloridaCommerce) administers LIHEAP and allocates funding directly to a network of community action agencies, also known as local agency providers, located throughout the state of Florida. The following is a summary of Florida's Low-Income Home Energy Assistance Program: The program cannot pay for water, sewer or telephone services. The local LIHEAP provider makes the payments directly to the utility company on the customer's behalf.

A customer may be eligible if he or she meets the following requirements:

Have a total income no more than 60% of the Florida State Median Income;

Be responsible for paying the home heating or cooling bills;

Be a resident of Florida;

and Be a U.S. Citizen, qualified alien or permanent resident of the U.S.


4. Request Approval of Change Order with Ten 8 Fire Equipment for Vehicle Maintenance on Fire Apparatus. This is a request to approve a Change Order for PO 23-00510 with Ten 8 Fire Equipment for fire apparatus maintenance totaling $6,499.93. The original PO was established as a blanket PO totaling $19,520.00 for vehicle maintenance and repairs. This Change Order is to cover the completion of work on fire apparatus that was requested before the Purchase Order maximum amount was expended. The Ten 8 Fire Equipment invoice for apparatus service and repairs was received after the original PO dollars were expended.


5.Request Approval to Waive Fees for Use of the Martin Luther King Center by TK Law. This is a request for City Council to waive rental fees for use of the Martin Luther King Center by TK Law for a free legal advice clinic on March 2, 2024.


6.Request Approval to Waive Fees for Use of the Mount Dora Music Hall by Shaping heARTS. This is a request for City Council to waive rental fees for use of the Mount Dora Music Hall by Shaping heARTS for community performances on March 23, 2024 & May 11, 2024.


7.Request Adoption of Resolution No. 2023-43, Adoption of Fund Balance Policy. The City will maintain reservations of Fund Balance / Net Position in accordance with Governmental Accounting Standards Board Statement No. 54, Fund Balance Reporting and Governmental Fund Type Definitions and Statement No. 63 Financial Reporting of Deferred Outflows of Resources, Deferred Inflow of Resources, and Net Position. Fund Balance shall be composed of non-spendable, restricted, unrestricted, committed, assigned and unassigned amounts.


8.Request Adoption of Resolution No. 2023-46, Accepting the FY 2022-2023 Annual Comprehensive Financial Report/Audit (ACFR) prepared by MSL, P.A., and adopting Time Parameters and Procedures. The Annual Comprehensive Financial Report (ACFR) for the year ending September 30, 2022, has been completed. The ACFR fulfills the requirements of the City Charter, Florida Statutes, and the Rules of the Florida Auditor General. This is a request for the City Council to adopt Resolution No. 2023-46, accepting the FY 2021-2022 Annual Comprehensive Financial Report (ACFR)/Audit prepared by MSL, P.A. and adopt Time Parameters and Procedures.

ACTION ITEMS

1. Request Approval of the Interlocal Agreement Between the City of Mount Dora and Lake County Related to the Maintenance of Certain Facilities for the Lake County Roundabout Project at Eudora Road/CR19/Old Highway 441. This is a request for the Council to approve an interlocal agreement with Lake County regarding maintenance of certain facilities for a new County roundabout to be constructed at the Eudora Road / CR-19 / Old Highway 441 intersection.

**The agreement attached at the time of the publication of this agenda is the original agreement sent by Lake County to the City. It was confirmed on September 15, 2023, that the attached agreement has been reviewed and approved by the Lake County Attorney. The attached agreement has not yet been reviewed or approved by the City Attorney. The City Attorney has not been involved in any of the negotiations for this agreement. Staff is requesting the City Attorney review the attached agreement before the September 21, 2023, City Council Regular Session.**


2. Acceptance of Resignation of Sherry G. Sutphen as City Attorney and Termination of Legal Services Agreement with Roper, P.A.


3. Award RLOI 23-GS-016 City Attorney Services to Shepard, Smith, Kohlmyer & Hand, P.A., Appointing Andrew J. Hand, Esq. and Patrick Brackins, Esq. as City Attorneys, and Authorizing the Mayor to Execute the Letter of Engagement. This is a request for City Council to award RLOI 23-GS-016 City Attorney Services to Shepard, Smith, Kohlmyer & Hand, P.A., appointing Andrew J. Hand, Esq. and Patrick Brackins, Esq. of as City Attorneys, and authorizing the Mayor to execute the Letter of Engagement. The firm proposes an hourly rate of $225.00 per hour for all shareholders and partners, $200.00 per hour for all associates, and $100.00 per hour for paralegals on matters that are not passed through or charged back to developers/applicants. Our current City Attorney rates are as follows: $190.00 per hour for all shareholders and partners, $155.00 per hour for all associates.


4. Determination of RFP Process for City Attorney Services. This is an opportunity for Council to determine the RFP process for City Attorney Services.


PUBLIC HEARINGS

1. Request Adoption of Resolution No. 2023-31 Replat for Storage Unlimited Lot 3. The purpose of this replat is to create two (2) industrial/warehouse lots associated with the Camp Avenue warehouse complex. The warehouse complex is located at the southwest corner of Camp Avenue and Rossiter Street. The warehouse facility was developed in 2002 with multiple warehouses, offices, light manufacturing and storage units. All parking and buildings are existing. The applicant wishes to divide the warehouse building spaces from one unit into two separate warehouse spaces/lots (proposed lots 3A and 3B). The existing warehouse is 5,788 square feet in size. Because the owner wishes to create two lots, a replat is required by city code (i.e subdivision of land of the City's Land Development Code). Both lots have been configured for consistency with the underlying PUD zoning district and the City's Land Development Code platting requirements.


2. Request Final Reading and Adoption of Ordinance No. 2023-11, Land 462 Development Code Amendment. City staff have compiled multiple revisions to the Land Development Code (LDC). The Development Review Committee members routinely track new trends and any code sections that need updating. The proposed LDC changes are required in order to provide code clarifications and consistency. The previous code update cycles for wholesale changes were in 2020 (sign code and the Wolf Branch Innovation Zoning Districts) and 2021 (murals and building height). The model home ordinance was the most recent amendment.


3. Request Final Reading and Adoption of Ordinance No. 2023-13, Annexation for the City of Mount Dora Niles Road (19.97 Acres). The proposed annexation of the City lands is eligible for annexation. The proposed annexation is a result of the City recently acquiring a portion of the former Florida Department of Transportation (FDOT) surplus land not needed for the SR 46 improvements. The property is located at the terminus of Niles Road and totals 19.97 acres. The lands are eligible for annexation, contiguous to existing city limits.


4. Request Final Reading and Adoption of Ordinance No. 2023-15, Change in Zoning for City of Mount Dora Niles Road (19.97 Acres). These lands are associated with companion annexation. The land was recently transferred by the Florida Department of Transportation (FDOT) to the City as surplus land. As part of the annexation, city land use and zoning assignments are required. The change in zoning is from County Agriculture to City PLI (Public Lands Institutional). This proposed zoning is consistent with the surrounding area. A portion of the City land is anticipated to be used for the Niles Road extension. Other city public uses in the future could be contemplated, but there are no immediate city projects for this site.


5. Request Adoption of Resolution No. 2023-40, Approval of Final Millage Rate. The Lake County Property Appraiser has certified the gross taxable value of property for operating purposes within the City of Mount Dora as $1,804,052,938 and has certified a rolled-back rate of 5.4731 per $1,000 of taxable value for the City of Mount Dora. The City Council of the City of Mount Dora, Florida, deems it necessary to levy and does hereby levy a final tax of $5.9603 mills upon all real and personal property within the City for operational purposes. The operating levy of $5.9603 mill represents an 8.90% increase from the rolled-back rate of $5.4731 per $1,000 of taxable value.


6. Request Adoption of Resolution No. 2023-41, Approval of Final Budget. The City Council of the City of Mount Dora has complied with all requirements and procedures of Florida law in processing this Resolution. City Council, pursuant to the Charter of the City of Mount Dora and Chapter 166, Florida Statutes, does hereby adopt the Final General Fund, Enterprise Funds and all other related Fund Budgets and Capital Improvement Programs (CIP's), in the amount of $182,257,022.

1. Proposed Consent Order re: OGC Case No. 23-0151. This is an opportunity for City Council to discuss and provide comments and suggested changes, if any, to the proposed consent order in reference to OGC Case No. 23-0151.
