APPROVAL OF AGENDA  

CONSENT AGENDA

1. Request Approval of a Task Authorization with Faden Builders, Inc for Rehabilitation of the South Ground Storage Tank at Water Treatment Plant No. 1. The south potable water storage tank at WTP#1 is in need of routine maintenance, including resurfacing of the interior and exterior surfaces of the tank. This is a necessary project to extend the service life of the south potable water storage tank at WTP#1. The Guaranteed Maximum Price (GMP) of the rehab is $408,300.

2. Request Approval to Apply for the Environmental and Climate Justice Community Change Grant and Request Authorization for the Mayor to Sign the Application Once Complete. The Environmental and Climate Justice Community Change Grant is a 0% matching grant. Organizations may apply for up to $20,000,000.00 in state funds to support their project. The Mount Dora Community Resource and Recreation Center is a great project for this funding. This grant encompasses community-driven projects that improve sustainability. The project should address one or more of the following: 1. Reducing and preventing pollution. 2. Building resilience to climate change and mitigating current and future climate risks. 3. Enhancing meaningful involvement in government processes related to environmental and climate justice. 4. Expanding access to high-quality jobs and economic opportunity through workforce development; and 5. Bolstering community strength by ensuring that local residents receive the benefits of investments and have the opportunity to build on them for current and future generations. City staff will work with Borrelli and Partners, and the grant writer to identify items that would be included in this grant. The potential grant funding for this project could be very extensive and is worth pursuing based on the grant details and all that is included in this facility.

3. Request Approval of Task Authorization with Kimley-Horn and Associates, Inc. for Supply of Odor Monitoring Equipment and Related Services. The City's odor control plan will be implemented by deploying twelve (12) hydrogen sulfide sensors along with four (4) mercaptan sensors and five (5) Tedlar air sample bags. The Tedlar bags are used to take air samples which will be sent to a laboratory for analysis to determine the chemical constituents captured with the bag. The task authorization is in the amount of $127,260.00 and includes a 20% contingency for use in the event any of the equipment fails and requires replacement during the term of the 180-day monitoring period. The odor control activities in relation to the Consent Order from FDEP were not budgeted and will be part of the Mid-Year Budget Amendment on April 16th Regular Council Meeting.

4. Request Approval of Piggyback Agreement with American Sidewalk Management for Sidewalk Inspection, Grinding, Removal, and Repairs. This is a request for Council to approve a piggyback agreement with American Sidewalk Management for inspection, grinding, removal, and repairs of damaged sidewalk for safety and compliance with Americans with Disabilities Act requirements. Currently, the Sidewalk ADA Compliance R&R account has approximately $95,000 remaining. We plan to spend the funds available for sidewalk repair this fiscal year on this contract before October.

5. Approval of Employment Contract with Vince Sandersfeld, Acting City Manager. On January 22, City Council appointed Vince Sandersfeld to the position of Acting City Manager. Subsequently, on March 19, 2024, the City Council authorized the City Attorney to negotiate an agreement with Mr. Sandersfeld.

ACTION ITEMS

1. Request Approval of Real Property Purchase Agreement for 308 E. 5th Avenue. The City has the opportunity to purchase the office building and parking lot located at 308 East 5th Avenue diagonally across the street from City Hall. The lot size is 98 ft by 127 ft (or 12,446 sq. ft.) . The building (2-stories) size is 3,732 sq. ft. with 15 existing parking spaces. The City's Building Division and other City offices are in need of additional office space. There is the potential to add additional parking spots to the 12,445 sq. ft. property. The City has the opportunity to purchase and renovate this property with funds from the Building Division revenues. Funds are available from the Building Division for the land purchase. The asking price for this property is $1,975,000.

PUBLIC HEARINGS - RESOLUTIONS/ORDINANCES

1. Request Approval of Resolution No. 2024-04, Nathan's Corner Plat (3 Duplex Lots and 3 Single-Family Lots). The subject property previously received City Council approval for the Harden Estates on September 20, 2017, for a six (6) lot residential subdivision (3 single-family lots and 3 duplex lots) named Harden Estates. The Harden Estates replat expired on September 20, 2019, and was refiled as Nathan's Corner for the same configuration. The applicant is requesting final plat approval for the Nathan's Corner residential subdivision. The development project consists of a single tax parcel containing approximately 1.50 acres located on the south side of 19th Avenue and on the north side of Fearon Avenue. The site is located east of Donnelly Street. The subject property is zoned R-2 and has been designated with a Medium Density (MD) future land use classification in accordance with the City of Mount Dora 2045 Comprehensive Plan. The Final Plan includes a grading plan and utility plan to demonstrate compliance with the City's adopted Land Development Code. Each lot is platted with drainage and utility easements along the perimeter of the properties to protect drainage design and utility infrastructure.

2. Request approval of First Reading of Ordinance No. 2024-08, Amendment to Section 3.5 of the Land Development Code Donnelly Street Setback Requirements. Section 3.5.2 of the City's Land Development Code has a general setback requirement for future road widening. This increased setback may be required to ensure proper setbacks from a planned right-of-way on any road or street that is programmed for widening. This code section states building setback should be 100 feet from the centerline along Donnelly Street. In order to remove any confusion that Donnelly Street has a "planned" setback of 100 feet, staff recommends this requirement be removed altogether from the future road widening setback list. There are no city plans to increase travel lanes or expand Donnelly Street. Also, numerous buildings are already within 100 feet setback area. This code change removes any possible misinterpretations of these setback requirements for a redevelopment corridor along Donnelly Street.

3. Request  approval of First Reading of Ordinance No. 2024-09, Amendment to Section 34-127 of the Mount Dora Code of Ordinances General Employee Retirement System to Clarify Fire Chief Optional Inclusion. Under the personnel section of the Mount Dora Code of Ordinances there are the various retirement and pension funds for general employees, police, and fire. The firefighters pension fund has a provision that allows a “new” Fire Chief to either select the Fire Pension Fund or the General Employee Retirement System at time of on-boarding with the City.  However, the definition listed in the General Employee Retirement conflicts with the Fire Pension language for this option. There is a code inconsistency that is recommended to be corrected in the Code of Ordinances.  This issue was recently discovered and city staff along with city legal have prepared an amendment to this code section accordingly.

4. Request Adoption of Resolution 2024-01, Adoption of Cybersecurity Framework. Florida Statute 282.3185, also referred to as the Local Government Cybersecurity Act, was enacted in 2022 and states under section (4) (a): Each local government shall adopt cybersecurity standards that safeguard its data, information technology, and information technology resources to ensure availability, confidentiality, and integrity. The cybersecurity standards must be consistent with generally accepted best practices for cybersecurity, including the National Institute of Standards and Technology Cybersecurity Framework. (4)(c) Each municipality with a population less than 25,000 must adopt the cybersecurity standards required by this subsection by January 1, 2025.

5. Request Adoption of Resolution No. 2024-11, Approving Fireworks Launch and closure of Grantham Point and Simpson Cove Docks Closure on May 25, 2024, Corn Festival Event. The City of Mount Dora wishes to sponsor and host a fireworks display as part of the Inaugural Mount Dora Corn Festival. The fireworks portion of this event is scheduled for May 25, 2024, and requires the closing of Grantham Point and Simpson Cove Docks in order to launch fireworks. The City has complied with all requirements and procedures for the fireworks display related to this event. $5,000.00 has been budgeted for the fireworks display at this event.

6. Request approval of Resolution 2024-12, Establishing a Charter Review ad hoc Committee. As directed by City Council on March 19, 2024, and pursuant to the City of Mount Dora Charter, Section 9, of the Mount Dora Code of Ordinances beginning in 2011, the City Council shall cause its Charter to be reviewed, and thereafter, no less than once every five years. The Charter shall be reviewed once every five years by ad hoc committee and the city attorney. The previous Charter was amended by Ordinance No. 2019-14 adopted on August 6, 2019.
