CONSENT AGENDA


1. Request Approval of Cost-Share Agreement between St. Johns River Water Management District and the City of Mount Dora for Wastewater Improvements at WWTP#1. On February 1, 2022, City Council authorized staff to apply to St Johns River Water Management District (SJRWMD) for a Cost Share Agreement (Grant) with a cost share opportunity up to $3,000,000.00 to supplement planned rehabilitation improvements at the Wastewater # 1 treatment facility. The Board of Governors approved the City's cost-share grant application at their meeting on May 10, 2022. SJRWMD awards funds to help alleviate the construction cost portion of the project that improves local water quality. The City's wastewater # 1 plant rehabilitation project meets the SJRWMD cost share criteria with its modern treatment improvements.  The updated treatment and equipment will also be more efficient, reduce operational costs and provide additional capacity to meet future wastewater needs for years to come.


2. Request Approval of Interlocal Agreement between Lake County and the City of Mount Dora for Use of Lake County Library Impact Fees for Manga Collection. Library staff submitted an $11,000 funding request for Lake County Library Impact Fee funds to partially fund an expansion of the Mount Dora Library's manga collection (see Exhibit A of attached agreement). On October 25, 2022, the Lake Board of County Commissioners voted to approve this request. An Interlocal Agreement with Lake County is now required in order to proceed with the project.


3. Request Approval of the Fourth Amendment to the Solid Waste Agreement between the City of Mount Dora and Waste Management Inc. of Florida. Waste Management is the City solid waste franchise provider for residential and commercial customers. Waste Management was awarded the franchise service in 2013. The agreement was amended in July 2018 with Resolution No. 2018-53 to change garbage pick up to once per week. The second amendment to the solid waste agreement was approved by the City Council on January 5, 2021 by Resolution 2021-02 to stop curbside recycling. The third amendment to the solid waste agreement was approved by the City Council on January 18, 2022. The current contract ends in 2027. The proposed rate that Waste Management charges for both residential and commercial solid waste services to the City is projected to increase by 3.5 percent pursuant to the contract agreement. A one-time Inflation Recovery Request of 4.1 percent was submitted by Waste Management due to uncontrollable circumstances. After negotiations with Waste Management, the one-time Inflation Recovery Request was lowered to 2.2 percent.


4. Request Approval of Amendment to the Solar Power Sales Contract with Florida Municipal Power Agency and the City of Mount Dora. This request is for City Council to acknowledge Amendment Number One to the Renewable Energy Power Purchase Agreement (REPPA) between Florida Municipal Power Agency (FMPA) and Florida Solar 7, LLC and Florida Solar 8, LLC, dated as of December 12, 2019 and approval of amendment to the Solar Power Sales Contract with FMPA. Due to unforeseen market conditions, namely inflation, regulatory, and supply chain issues, the viability of the project was threatened. FMPA and Origis Energy (the parent company of Florida Solar 7, LLC and Florida Solar 8, LLC) agreed to, in principle, certain amendments to the REPPAs regarding the purchase price of energy to be delivered. This new pricing is subject to approval by the FMPA Board of Directors and the solar project participants. The FMPA Board of Directors approved the revised pricing terms, and granted FMPA's General Manager & CEO the authority to execute revised REPPAs.

ACTION ITEMS


1. Request Approval of Amendment 4 to the Lease Agreement between Nickmax Properties, LLC, and the City of Mount Dora for the Robie Street Property. This is a request for City Council to approve Amendment 4 to the existing 1501 Robie Avenue Property lease agreement between Nickmax Properties and the City of Mount Dora. This amendment allows for the extension of the lease through September 30, 2024, while the new Public Works Facility is being constructed. Monthly rent for this property is $11,312 through September 2023 and $11,878 through September 2024.


2. Approval of Amendment 3 to the Professional Services Agreement between the City of Mount Dora and ADG for Public Works Facility Phase 2 Design and Engineering Services. Following a review and assessment of the City's bonded construction projects, on October 18, 2022, City Council directed staff to construct a new Public Works Facility on the Limit Avenue property, to include Administration offices for Electric, Public Works, and Water/Wastewater in addition to departmental operations and inventory warehouse.  The Limit Avenue Property will now only house the Public Works Facility, as City Council directed staff to undertake a renovation of the existing Fire Station 34.  Amendment 3 to the Professional Services Agreement includes Phase 1 design to add administrative offices and meet design standards, as well as Phase 2 design and engineering of the entire site, in the amount of $441,503.38.  Staff continues to work toward groundbreaking in 2023, and an updated project schedule will be forthcoming.


3. Request Adoption of Resolution No. 2023-02, Budget Amendment for WWTP #1 Repairs and Approval of Task Authorization/GMP (Guaranteed Maximum Price) for WWTP# 1 Repairs (Faden Builders). City Staff have identified repair items at Wastewater Treatment Plant #1 (WWTP#1). These repair items need to be performed ahead of the Wastewater Treatment Plant #1 Renovation project with Wharton-Smith. Scope of work for the repair items includes removal of soil stockpile, chain link fence replacement, demolition of holding tank and building, and installation of clarifier bracket supports. Staff identified Citywide CMAR contractor Faden Builders, Inc. to perform the repairs and present for approval the Task Authorization/GMP (Guaranteed Maximum Price) for this work in the amount of $289,070.04, as well as Resolution No. 2023-02, authorizing Budget Amendment for WWTP#1 Repairs.


4. Request Approval of Task Authorization/GMP (Guaranteed Maximum Price) for Pickleball Courts at Summerview Park (Faden). City staff requested and received approval from City Council on March 1, 2022, to move forward with design of the project at Summerview Park, to include six (6) pickleball courts.  City Council subsequently approved funding in the amount of $600,000 from Parks Impact Fees to be earmarked for the Pickleball Courts at Summerview Park via Resolution No. 2022-25. Staff engaged Citywide CMAR Evergreen Construction, which was later acquired by Faden Builders, Inc., also an approved Citywide CMAR contractor.  Faden assumed the Summerview Pickleball Courts project, keeping the same team assigned to the project. Once construction drawings were complete, Faden completed competitive bidding and presents the proposed Task Authorization/GMP in the amount of $366,900. The proposed task authorization includes six (6) pickleball courts, conduit placed for future lighting, and fabric windscreen on the perimeter fencing. Following feedback and with additional monies available, Staff are moving forward with a photometric study and lighting for the courts, which will be brought back to Council as separate items.
